Conservation Commission Meeting Minutes

The meeting began at 7:00 p.m.

Forest Stewardship - Ken Strom moved to accept the Forest Stewardship plan unless there are any objections by Anthony or Rob. N. Rocheleau seconded and the vote was unanimous.

N.O.I. Alden Woods - Dan Leahy, Clea Blair Jr. and George Kiritsy were present. The applicant has revised the NOI to reflect the addition of the subdivision but did not include a stabilization or erosion control plan to accompany the NOI form. D. Leahy passed out a narrative of the work being done on the stockpile material. He also brought in water samples to show the turbidity of the water at different areas on the site. K. Strom stated that stone should be used in place of wood chips where the trucks will be driving. The new NOI plan should show the lots and how they will be graded (in general). M. Kennedy wants details of the temporary access road for the pile of fill. A plan needs to be submitted to P. Harding or D. Nason on how the entire road surface will be managed where there is truck or excavator traffic. It should also show grading and erosion controls.

An Enforcement Order was issued on this project for a house being constructed at 156 Wachusett Street. The lot included grading for the sewer easement that had a previous Enforcement Order. At the April 5, 2006 meeting the Conservation Commission requested an erosion and sedimentation control plan for the build-out of the subdivision. Because grading occurred on the lot associated with the construction of the easement, that contributed to three previously documented violations, the Commission felt the Enforcement Order was relevant. The applicant felt the Board did not have jurisdiction over the construction of the house because the violation that occurred was in relation to the easement only and does not make the entire lot jurisdictional.

M. Kennedy noted that the drainage calcs submitted were not stamped and the assumption of the terrain is incorrect. They did not have any water quality calcs and M. Kennedy feels the plans are under designed. This case was continued to June 7th.

NOI Courtney Dr. - Dan Leahy submitted a brief of the maintenance plan for the detention pond. M. Kennedy noted that the wording should reflect that the owner is responsible for the pond maintenance. The Board also wanted the summary sheet on the approximate cost to maintain the pond, state that the monies will be put into an interest bearing account. The O & M and the "cost summary sheet" will need to be cross-referenced and recorded with the Deed. P. Harding wants Town Counsel to review the documents. This case was continued to June 7th.

1800 Main St. - Charles Caron was present. He stated that 75% of the area has been cleaned up. They hope to have the entire area cleaned up in a couple of weeks. The Board stated that the applicant would only need to submit a report for the June 7th meeting as long as L. Anderson has seen the site when it is completed. This case was continued to June 7th.

NOI Fisher Terrace - K. Strom recused himself. J. Tetreault went through all the plan changes. They are changing the two detention ponds into a single retention pond and have changed the road design. M. Kennedy asked if they used the lowest orifice in the pond, if the calcs would still be okay. The applicant needs to resubmit the calculations showing the lowest orifice point. M. Scott moved to close the hearing and L. Anderson seconded. The vote was unanimous with K. Strom abstaining.

NOI 600 Manning St. - Ben Clark and Tom Capone were present. Ben Clark showed the revisions that have been made to the site plan. He will present a request of waiver to the Planning Board to eliminate the curbs on one side of the road allowing road run off to drain to adjacent ground. This case was continued to June 7th.

Violation - Rt. 68 Busy Bee - Doug Andrysick and Rick Lovely were present. P. Harding noted that excavation and construction had been done in and abutting the wetlands. The business is classified 61A but the work that was done is outside of that classification. The Board wants a plan showing where the wetlands will be restored. A NOI will be filed for the violation as well as a proposed building. The case was continued to June 7th.

NOI 179 Doyle Rd. - Glen Krevosky and Rick Sampson were present. New plans were brought to this meeting and the changes were discussed. Revised plans to be submitted, #5 will be stricken, #2 the spacing will be changed to 10'-12' and #6 will reflect "or wildflower mix". K. Strom moved to close the hearing and N. Rocheleau seconded. The vote was unanimous.

NOI 120 Moscow Rd. - Mark Santoro and Charles Snow were present. This case is for remediation to a septic system and a proposed addition to the rear of the home. After some discussion L. Anderson moved to close the hearing and K. Strom seconded. The vote was unanimous.

NOI 26 Bailey Rd. - Jim Morin was present. This case is for septic system repairs. N. Rocheleau moved to close the hearing and M. Scott seconded. The vote was unanimous.

COC Quinapoxet Woods - There is no new information. Continued to June 7th.

COCs 20 Cimarron, 64 & 86 Greenwood Parkway - N. Rocheleau moved to issue COCs for 20 Cimarron, 64 Greenwood Parkway and 86 Greenwood Parkway. M. Scott seconded and the vote was unanimous.

Stormwater Management Guidelines - P. Harding will email the new regulations to the Board.

Minutes - K. Strom moved to accept the minutes of April 5, 2006, N. Rocheleau seconded and the vote was unanimous.

Orders Of Conditions

Fisher Terrace - M. Scott moved to issue a standard OOC with 2 special conditions: 1. Drainage calcs using the lowest orifice for the 2, 10 and 100-yr. storms will be submitted and reviewed before any construction may occur. 2. A third party inspector will be required to witness all construction that is located within the buffer zone to ensure the wetlands are properly protected. Erosion controls must be installed and inspected by the third party consultant and the Conservation Agent or Commission member prior to the start of construction. Inspections will be required based on the Commission or its Agent's opinion depending on where construction is occurring on the site and to what degree and proximity to wetlands it is located. L. Anderson seconded and the vote was unanimous with K. Strom abstaining.

179 Doyle Rd. - K. Strom moved to issue a standard OOC per revised plans. M. Scott seconded and the vote was unanimous.

120 Moscow Rd. - N. Rocheleau moved to issue a standard OOC, M. Scott seconded and the vote was unanimous.

26 Bailey Rd. - M. Scott moved to issue a standard OOC, N. Rocheleau seconded and the vote was unanimous.

L. Anderson moved to close the meeting at 9:30 p.m., N. Rocheleau seconded and the vote was unanimous.
